The Supreme Court on Thursday delivered a split verdict in the Karnataka Hijab ban case. The two judge bench of justices Hemant Gupta and Sudhanshu Dhulia divided in its view and the matter was directed to be placed before the Chief Justice of India UU Lalit for assigning the matter to a three-judge bench. The court had reserved its decision in the matter on September 22 after hearing extensive arguments by the petitioners on the ban of hijab in educational institutions. On March 15, the Karnataka High Court dismissed the petitions filed by the a section of Muslim students of the Government pre-university girls college in Karnataka’s Udupi seeking to wear the hijab inside classroom and the Karnataka High Court ruled that a hijab is not a part of the essential religious practice in Islamic faith.
While allowing the appeals against the high court verdict justice Dhulia said he has quashed the state government February 5, 2022 order banning which disturb equality, integrity, and public order in school and colleges.
